good morning, i'm chris jansing. tomorrow could be the most critical night in the race for president. the candidates are giving us a preview of their debate strategies now. president obama left a swanky resort where he is doing debate prep to deliver pizzas to volunteers in nevada. it was a break from what we hear he is working on including shortening and sharpening his answers. not his idea of a good time. >> it was very nice. basically, they are keeping me indoors all the time. it's a drag.

they're making me do my homework. >> mitt romney rallied in a crowd in denver. even though he's been practicing zingers, he tried to play down the need for a victory. >> people want to know who is going to win, who is going to score the punches and who is going to make the biggest difference in the arguments they make and there's going to be all the scoring of winning and losing. in my view it's not the winning and losing, the people themselves, it's something bigger than that. these debates are an opportunity for each of us to describe the pathway forward for america we would choose. >> i want to bring in john harwood and e.j. deion, author of "our divided political heart." thank you for coming on. we've been hearing this expectation game being played, the other side trying to make the other one seem as if they are the greatest debater who

ever lived. let's start with a reality check and strength and weaknesses of these candidates. let's start with president obama. what is the strength in this debate? >> he's very well informed. he is a fluid speaker. he has served as president. he's got a tremendous amount of information at his command. he doesn't mess up very often. he simply doesn't create the memorable gaffe very frequently, although he's had a couple of things with "you didn't build that" and that sort of thing. >> his weakness? >> his weakness is he can come off as prophesorial and arrogant and long-winded. >> how about you? what do you think about the president? what has he got going for him? >> he should twitter because it would force him into shorter

answers. he's got the advantage romney has a bunch of weaknesses obvious in the polls. he can keep trying to shift the debate toward those romney weaknesses. in particular, the sense he's out of touch with the middle class. you'll hear the number 47 as often as obama can get it into the debate. >> you think he can come off as aloof. when you look at the polls, the one thing he's consistently exceeded mitt romney at is likability. >> right. yet he does have -- it's partly it's proffesorial. when he looks like john kennedy he's on an upslope. he's not so good when he thinks he is way ahead and konts respect an opponent. i have a hunch he is hearing that from his folks in that room in nevada saying, you can't make a mistake like that. >> part of it is who you compare

him to. he's aloof compared to bill clinton. bill clinton has a touch. >> everyone is aloof compared to bill clinton. >> exactly. >> let's talk about mitt romney. strengths, weakness. >> mitt romney's strength is that he is, comes across as competent, as a capable human being. as somebody who projects an air of authority, especially when he talks about the economy. that is the private sector track record. the flip side, the weakness is the 47%. some of the attacks he's taken in terms of that business record. i think mitt romney's biggest problem though, chris, is the sense people can't be sure exactly if he believes what he's saying. he needs to project authentic passion for what he believes his plan would do for the american economy to make the 47% lives better as well as the other 53. >> what do you think, e.j.? >> i thought the definitive line on politics, what you need is sincerity, if you can fake that, you can do anything. it's troublesome on this

question of authenticate. what is authenticity? romney has taken a number of positions on issues which you will be sure obama will try to sneak in there somehow. he can be ferocious and disciplined. go back to that newt gingrich debate in florida where he dispatched newt gingrich. he can be very good. i think he can have real highs, but also can have lows and say the darnedest things sometimes. >> i want to bring in georgia congressman tom price. good to see you, good morning. >> good to be with you. >> one of the things we are being told from inside the romney camp is he is getting ready for the 47% video. he knows the question is going to come up. this is what his advisor says. "we wouldn't be surprised, obviously, if that came up in the debate, and the governor's prepared, obviously, to respond about it. the fact is as governor romney has said repeatedly, he is

running to help 100% of americans." he has said that. he said that repeatedly. it still resonating in a negative way with voters. what do you think he has to say about the 47% which has dogged his campaign since that video came out? >> remember, that was recorded during a fund-raising activity. it was a cut. this is an opportunity for governor romney to have his message come through unfiltered to the american people. that's, i think, what needs to come through. his sincerity, his warmth, his intellect, his optimism on the future of america and how we solve the challenges, and the two roads. the road the president defined over the last four years, we don't think the american people have embraced and will continue to embrace, and the road of optimism and pro-growth policies to get america back to work. that's the choice. >> isn't the problem for mitt

romney that people obviously believe, which was the mantra, that the democratic party tried to define that the obama campaign tried to define, that is not a guy for the 100%? this is a guy who frankly favors the wealthy. people like him. and that he doesn't get the cares and worries of the average american? >> i think that's the divide and conquer mentality. mitt romney cares deeply about the american people. he cares deeply about the future of this country and our kids and grandkids. that's way can bring forward in this debate because it will be unfiltered. it won't be split and cut by the media or by whoever is slicing and diesing any recorded messages that have been done before. this is an unfiltered opportunity for governor romney to lay out his optimistic and upbeat plan for the american people and for our great country. that's why i'm so excited about tomorrow night. >> let me ask you about

something dave gertz wrote in "the new york times" today. he suggested an opening statement for mitt romney. let me read part of it for you. i'm a nonideological guy running in an ideological age and i'm pretending to be more of an ideologue. i ended up running myself down. it hasn't worked. i'm behind. i decided to run the last month of this campaign as myself. there has been a criticism that he has gone from being a moderate to a conservative. has he become too conservative for the general electorate, and do you consider mitt romney to be a true conservative? >> sure, he's a conservative. what he is is a problem solver. his entire life, whether it's his professional life, whether it's in the volunteer activities he did for the olympics, all the things he's done is taken real serious challenges and problems and solved them. his unique opportunity in

america right now is to turn the country around, which is what he did for the companies and what he did for the olympics. i think he's uniquely qualified right now in american history to do what exactly america needs. that is to turn this country around, get it back on track and begin to create jobs and grow that economy. >> congressman, tom price, thank you very much. we are going to take a pause. we have breaking news right now. a judge has issued a decision in pennsylvania's controversial voter i.d. law. we have been waiting for this. nbc's justice correspondent pete williams joins me live. >> the judge said the new voter i.d. law in pennsylvania, the strict new i.d. law cannot go in effect for the general election. there is a chance the state could appeal this to the state's supreme court, but based on what the supreme court said last time they looked at this, it's doubtful they would succeed there. what the judge says here is yes, it's true. the state has said we can fix some of the problems that have come up before, but he says, i question whether there is enough

time now to fix these problems. i think there are going to be more problems down the road putting this into effect like we've already seen, he says. he believes that the gap between the photo i.d.'s issued and the estimated need cannot be closed before the election. in other words, he says all the people who would have to get new photo i.d.s, he doubts there is enough time for them to get them. he says i'm not convinced in my predictive judgment there won't be any voter disenfranchisement arising out of this new law. pennsylvania in march passed this new law requiring voter i.d.s. people started going to get them and the state said, wait a minute. we can't just give you a voter i.d. because only thing we can give you is the nondriver's license state department of transportation i.d. that is a secure form of i.d. you need a birth certificate with a raised seal, two other forms of identification, proof of your current residence. the state said maybe we don't need to do all that.

we'll revise the procedures. the judge says there isn't enough time left to fix all these current and potential problems and make sure everybody who needs to vote will be able to vote before the election. he put a hold on this new voter i.d. it will not be going into effect for the general election on november 6th. >> pete williams, thank you so much for that update. let me go back to our panelists. it does seem there is a pattern that the democrats have been successful in challenging these laws. >> obviously, this is a big victory for the obama campaign. they've been trying to knock these laws down. they are unequal barriers for poor voters that don't have i.d.s. it's important these laws being knocked down. what the judge said points to the very practical problems involved here. people say it's simple. you get an i.d. a lot of people who don't drive in the inner city don't need driver's licensees. the hoops you have to go through are a real barrier to vote in.

this is an important decision. i'm hoping you see decisions like this in other states. >> let me wrap up the other conversation we were having. i know you wanted to jump in on what you heard from congressman price. >> first of all, congressman said it was the 47% video was something that was done at a fund-raiser in the debate will be an opportunity to talk unfiltered. i don't know why anyone should not assume remarks he didn't know were being recorded to a group of donors were completely unfiltered. exactly what mitt romney was thinking. when congressman price said the democrats are running a divide and conquer campaign, if you tell a bunch of donors, you're not worried about 47%. that is divide and conquer. the final point is the passage you read from david brooks is what i'm talking about. mitt romney did not have a successful business career because he's an idiot or empty suit. he's got real strengths. he's got to figure out how to figure out how those strengths are applicable to america's

economic problems, convince americans he can bring them to bear to their benefit. >> own it. >> he's got to keep it from being a fake ideologue. i thought the message was more on target than the romney campaign. he needs to put obama on the defensive and needs to remake his image. i think he needs a long strategy through all the debates. i'm not sure he can do all he needs to do in one debate. >> it's so great to have both of you here. come back. thank you. lockheed martin and other defense contractors agreed to a white house request not to give lay-off notices to employees days before the election in november. those companies are anticipating thousands of lay-offs because of defense budget cuts and they are required to give workers 60 days notice. it's highly unlikely any budget cuts will be decided on before the election. the administration argues that pink slips should not go out

specifically geared to domestic issues. what based on your conversations with other mayors do these people want to hear from the candidates and they need to address tomorrow night? >> i think it's very important. i believe as we heard in the past, you're going to see and hear two fundamental differences as far as genders are concerned with regard to the american people. the american people want to hear about the issues that matter most to them. those are the issues around jobs, the economy, safety in america. their children and education. the things that really meet the american people where they are. that's why we are also here today and the next 30, 45 minutes where u.s. mayors will get together and talk about those very important issues, as well. >> unemployment in your state is above the national average, about 8.2% now. >> right. >> you criticized president obama during the convention for pressuring governor romney to release his tax returns, saying that wasn't the issue that mattered the most. do you think the president is

addressing the issues that are most important in this campaign? >> i think our president has done a fundamental -- a phenomenal job addressing those issues. let me correct. it was not meant to be a criticism. it was correcting all of us to make sure we stay focused on the message where the american people are. we want to hear about jobs. we want to hear about health care. we want to hear about those things that are really right in front of the american people today. the president certainly got on that stage in charlotte and did exactly what we all expected and knew he could do. that was to bring the issues right to the american people. >> let me ask but this group called mayors against illegal guns. you're out with a new ad featuring a survivor of the aurora movie theater shooting, asking candidates to address the issue of gun control at the debate. how likely do you think that is? how likely do you think this shooting, the shooting of a u.s. congresswoman, the subject comes

up when these horrific incidents happen, but little changes. do you think the country is in the mood for change? >> here in denver we have the most restrictive assault weapons ban in the nation. we'll continue to have that assault ban in place here in denver, colorado. when we look at what happened in aurora, what we recognize from my point of view is we need to take a comprehensive look at this whole issue of, not only guns and gun control is a part of it, but mental health is a part of it. families and education issues are a part of it. when we look at what happened in you are aoa, we recognize a bigger issue that must be addressed here if we focus on gun control, we lose the opportunity to address these issues. my point and position has been, let's make the gun control conversation about a larger, more comprehensive addressing of major problems that ail our community by the videos, violence in movies, mental issues and the breakdown of the american family. these are the issues on a

broader scale, on the national level we have to address. denver can't do it alone, nor other cities across this nation. >> let me ask you about what's going on in your state in terms of the presidential campaign. this is still a battleground state. it is still too close to clearly put in the president's column. what will move the needle in colorado? >> i think when we step back and look at it, the fact is we have a great deal of independence in colorado. there is a great deal of optimism going on in colorado. we had consecutive months of job growth. people are feeling better when they think about it. the path in which we are on in the state of colorado and in this nation, i believe colorado will ultimately go for obama for that reason. we stand with the president. we ultimately believe we are not where we want to be, but far from where we started. that is an important thing when people step back and think about this decision we have to make.

two fundamental differences. we are going to look at those agendas and realize i believe in colorado we are on the right path. >> denver mayor michael hancock, thank you so much. we appreciate your time. >> you bet. thank you, chris. a new report claims you are almost guaranteed to pay higher taxes next year if the country goes off the fiscal cliff. the tax policy center says almost 90% of households would see their taxes go up if congress can't work out a deal on expiring tax cuts. the average hike would be $3,500 for middle income earners, a $2,000 increase. senate leaders say they are making progress on a plan. jack, you're a little boring. boring. boring. joe biden in north carolina and paul ryan on a bus tour in iowa. last night he was in dubuque. the first time at a public campaign event he delivered this line. >> the choice is clear, and here is what we are doing. we are entering the debate phase, the choice phase of this campaign. this choice is ever so clear. >> speaking of choice, has mitt romney's choice of paul ryan paid off? let's ask republican strategist and former gingrich campaign senior advisor david winston and nbc latino contributor, a senior fellow at the university of texas. good morning to both of you. will mitt romney have to and be able to defend paul ryan's budget plan at the debate tomorrow? >> clearly, the selection of paul ryan was an intent to give, sort of fill out this alternative. how was mitt romney going to be an alternative to whatever president obama's policies were.

that was a strategic shift from it being just simply a referendum on the president. it's not, it wasn't so much does he have to defend everything paul ryan did? it's how does paul ryan supplement what mitt romney is going to say in terms of how he offers this alternative and what we are going to see in terms of the debate is how the campaign decides to define that. >> paul ryan the last couple of days has taken a lot of criticism for his interview on fox news sunday when chris wallace grilled him how he paid for a 20% tax cut he and mitt romney proposed. he had no details. he was asked the question six or seven times. to be fair, has either side really given good strong details about their budgets or how they would move the economy forward? >> they started trickling out details in the five-point plan, and four-point plan. i think when it comes to paul ryan, the big question mark for me is florida. romney needs florida any way you slice it.

seniors get skittish when it comes to medicare. in 2008 barack obama took florida, the majority of seniors voted for john mccain because they were hesitant how the health care reform would take place. talking about ryan and medicare and seniors, it comes down to florida. >> florida, florida, florida, david. she is right about one thing. if you look at the poll, the one area where you see consistent movement poll after poll after poll toward barack obama has been with senior citizens. you know as well as i do, they are a consistent voting block. they go to the polls in larger percentages. has the obama administration been successful at branding the medicare plan of the republicans as voucher care and are senior citizens moving away because they're afraid of the medicare changes? >> the ryan budget plan existed in terms of the 2010 election when republicans won 65 plus seniors by 21 points.

part of the dynamic that exists here is, in fact, seniors are really unhappy with president obama's health care plan. what you see is this significant concern handling medicare, four years ago republicans would lose that by 25 points. now it's down in low single digits where republicans made significant progress. that is reflected in the medicare poll. >> why are senior citizens in the polls moving away from mitt romney toward barack obama. >> i guess i'm not seeing that in the survey the way you are. when i take a look at issue handling and medicare and seeing how we dramatically neutralize that issue, i'm not seeing it the same way. >> i think medicare is one question. the other question is senior citizens and who do they support? the movement is definitely toward barack obama. let me ask you a little about also the traditional role of the president. we all know it's the attack dog, right? as jennifer ruben put it in "the

washington post," paul ryan has been withering on both the economy and national security. as a communicator of what's wrong with the economy and even barack obama admits it hasn't gotten as good as it should be, victoria, has he been a good vice presidential candidate? >> i think he is the reverse. you traditionally want the attack dog. because romney lacks that charisma, that connection with regular folks, he wants paul ryan to be the nice guy. he wants folks to say i like this guy. in this particular election, i say we throw out that traditional role out the window and focus on paul ryan connecting. he can connect with regular folks, but where he has the most challenging road ahead it with seniors. it's not just about the message, it's about the messenger. when it comes to medicare and senior citizens, this is where joe biden has the leg up. >> victoria, david, good to see both of you. thank you so much. also making news, a

developing story out of arizona. the department of homeland security says a u.s. border patrol agent was killed. another hurt in a major drug corridor near the border with mexico. names of the victims and details of exactly what happened are not available yet. new flight recordings just came into our newsroom capturing another incident of airplane seats coming loose in the skies. for the second time in three days, an american airlines flight had to land early because of rows of seats being unbolted from the floor. yesterday a flight from new york to miami returned to jfk after the seats began moving around. take a listen. >> shall we are coming back. our seats 14 a, b and c, i think, are totally disconnected, loose. kind of like what happened the other day. >> same thing happened saturday on a boston to miami flight, american airlines says it is inspecting six other jets that recently had maintenance work done on the seats. six crew members are under arrest after two passenger boats

collided last noot in hong kong. look at these pictures. 38 people were killed. 100 more went to the hospital. authorities say a boat chartered for watching fireworks hit a ferry off the southwestern coast. police arrested crew members from both boats. still they are investigating what caused that deadly accident. this morning, investigators are looking into an accident in california after a truck slammed into an amtrak train yesterday injuring at least 20 people. the collision knocked two double-deck cars and an engine off the tracks. not clear if the crash was caused by driver error or a mail functioning crossing gate. big recall of peanut butter expanding to other nut products including almond and cashew butters. new mexico-based sunland, inc, was linked to several cases of salmonella. they were linked to trader joe's, whole foods, target and safeway. 30 people in 19 states have gotten sick from this strain of

salmonella. if you would like more information on the specifics go to www.cdc.gov/salmonella. check this out. four hunters nabbed a giant alligator in mississippi and lived to tell the tale. this gator weighed almost 700 pounds. it's a record for the state's hunting season. the men said it took 4 1/2 hours to hook it and wrestle it to shore. unbelievable. retailers are dreaming of a green christmas. national retail federation out with its holiday sales forecast. looking okay? >> i'm trying to get over the gator, quite frankly. let's take a look at what's going on with the busiest shopping season of the year. you're right. americans are expected to spend more, but not substantially so. in fact, the season sales are

expected to rise 4.1% this year. it's the smallest increase since 2009 which says we were up 0.3%. we've got to do our bit for the shopping season. >> toys "r" us fired another shot into the competition. >> it has. toys "r" us is offering a price-matching guarantee on all of its toys and products this holiday up until christmas eve. it does not include online offers except from its own websites, which are toys "r" us.com and babiesrus.com. it says items known to be widely out of stock or available only in limited quantities are excluded from the offer. this is another shot because the offer follows on from toys "r" us is free lay-away and toy reservation programs. retailers particularly toy makers can make up to 40% of their annual sales during these last three months of the year.
